Informational Reference on the Draft Law of Ukraine “On Amendments to Article 346 of the Criminal Code of Ukraine Concerning the Establishment of Liability for Public Call or Public Incitement to Violence Against a State or Public Figure, as well as Strengthening Liability for Threats or Violence against a State or Public Figure” (No. 14372 dated 12 January 2026)

Abstract. The informational reference examines the legal grounds for enhancing criminal liability for threats or acts of violence against a state or public figure in the context of the proposals set out in the draft Law of Ukraine (No. 14372 dated 12 January 2026).
The draft law is assessed as complying with the requirements of the Constitution of Ukraine, the fundamental principles of law-making and criminal legislation, and the provisions of international legal instruments establishing legal liability for threats, public calls for violence, or attacks against government representatives or political figures.
The research also identified certain risks that may hinder the effective implementation of the draft law in law enforcement practice and impede the achievement of its declared objective, namely strengthening the legislative protection of state or public figures and their close relatives from attacks on life, health and property, particularly in the context of repelling Russia’s armed aggression.
