Reform of Judicial and Prosecutorial Self-Governance Bodies in the Context of the European Commission’s Recommendations

The Research Service of the Verkhovna Rada of Ukraine has prepared an informational reference on the reform of judicial and prosecutorial self-governance bodies in Ukraine in the context of the European Commission’s recommendations and the EU accession negotiation process. The paper provides a structured overview of the transformation of these institutions, highlighting the shift from their establishment to the assessment of their actual institutional capacity to ensure fair justice, in line with Cluster 1 “Fundamentals” and the principle of non-regression.

Particular attention is paid to updates to the regulatory framework in 2024–2026, including the adoption of a revised Code of Judicial Ethics and its Commentary, amendments to the Rules of Procedure of the Congress of Judges of Ukraine and the Regulation on the Council of Judges of Ukraine, as well as the introduction of unified criteria for assessing judicial integrity. The reference also examines developments in prosecutorial self-governance, including the results of the functional audit of the Council of Prosecutors of Ukraine and initiatives aimed at strengthening its institutional autonomy.
