Strengthening the Independence of the Office of the Prosecutor General

The Research Service of the Verkhovna Rada of Ukraine has prepared an informational reference on the Draft Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Strengthening the Independence of the Office of the Prosecutor General” (No. 15343 of 22 June 2026).
The informational reference examines the legal grounds for improving the procedures for the appointment and dismissal of the Prosecutor General in the context of the provisions of the draft law. It analyses their compliance with the Constitution of Ukraine, the fundamental principles of law-making, and the current legislation governing the organisation and activities of the prosecution service.
Particular attention is paid to the recommendations of the European Commission and the Council of Europe, as well as to the provisions of the Rule of Law Roadmap concerning the independence and impartiality of prosecutors and the transparency and competitiveness of procedures for their selection and appointment. The document also examines the procedure proposed in the draft law for the competitive selection of candidates for the office of Prosecutor General with the participation of a special Selection Commission, as well as the procedure for a vote of no confidence in the Prosecutor General by the Verkhovna Rada of Ukraine.
