The Research Service of the Verkhovna Rada of Ukraine has prepared a parliamentary study on European Union and Council of Europe standards concerning the protection and processing of personal data in law enforcement.

The study analyses Council of Europe and European Union standards in the field of personal data protection in the activities of police and criminal justice authorities, as well as international legal instruments and the case law of the European Court of Human Rights, which together shape the European legal framework for the protection of informational privacy.

Particular attention is paid to the nature of interference with the right to privacy, the principles and legal grounds for the processing of personal data by competent authorities, and the need to distinguish data by categories of persons and by the nature of the information concerned.

The parliamentary study also examines the specific features of processing data on criminal convictions, the retention of biometric data and DNA profiles, the rights of data subjects, the obligations of data controllers, and issues related to independent supervision, liability, sanctions, and effective judicial protection.
